Treasury Outbound Investment Rules Restrict Biotech Capital
New United States Treasury regulations restrict cross-border investments in foreign artificial intelligence models used for genomics and drug discovery platforms.
The United States Department of the Treasury issued its final rule implementing Executive Order 14105, which regulates outbound investments in national security technologies. The mandate specifically limits United States venture capital and private equity backing for entities in designated foreign jurisdictions developing artificial intelligence systems trained on biological and mass-surveillance datasets.
The pharmaceutical and computational biology sectors had petitioned for explicit exemptions for computational drug discovery and biomedical software. The final text, however, maintains that systems designed or marketed for dual-use applications—including biological target identification and automated chemical synthesis—remain within notification or prohibition thresholds depending on aggregate compute benchmarks.
When you evaluate direct-to-consumer genetic panels or biomarker analysis services, check their terms of service to see where their computing infrastructure resides and how your raw sequence data is processed across international boundaries.
